About Our Site

The Site is an e-commerce and order management platform that allows local businesses to sell products, and allows users to browse, place orders, and coordinate deliveries. We reserve the right to introduce, update, or withdraw Services at our sole discretion.

1. Eligibility and Registration

You may register as a buyer or seller if you:

  • Are above the legal purchasing age in your jurisdiction;
  • Provide a valid UAE address for deliveries;
  • For sellers, hold a valid UAE trade license and provide authorization documents and banking details.

We may verify your information during registration and have the right to approve or reject any application.

2. Your Responsibilities

You agree to:

  • Maintain account confidentiality and notify us of unauthorized use.
  • Provide accurate, current, and complete information.
  • Use the Services lawfully and refrain from uploading or linking to any illegal, offensive, or restricted content.

You also agree not to:

  • Use the Services for fraud, spamming, or unsolicited communications;
  • Violate intellectual property rights or applicable laws;
  • Abuse or manipulate listings, pricing, or feedback systems;

3. Intellectual Property

All content on this Site (text, logos, images, etc.) is the property of Nearbys Marketing Management F.Z.E or our licensors. You may not use our trademarks or copy any material without written permission.

4. Use of Data

To process orders, we collect basic customer details (name, phone number, email, delivery address). These are used strictly for order fulfillment and are managed securely via third-party platforms (e.g., Shopify, payment gateways). We do not store or use this data for marketing or profiling.

User location (used for showing nearby stores) is stored only in the user’s local browser storage and not transmitted or stored on our servers.

5. Limitations of Liability

We are not liable for indirect, incidental, or consequential damages. Our maximum liability, where applicable, will be limited to the amount paid by you for the service or item in question.

6. Suspension or Termination

We reserve the right to suspend or terminate accounts in case of:

  • Abuse of our systems or delivery staff
  • Providing false or incomplete information

7. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the United Arab Emirates, and any disputes will be subject to the jurisdiction of UAE courts.
